A man who is awaiting sentencing for aggravated assault in the 2008 death of his common-law wife was arrested and charged again on Wednesday in Abbotsford.
Daniel Raymond Casgrain, 57, was charged with resisting or obstructing a police officer and breach of his bail conditions.
Const. Ian MacDonald said police received a call from a clothing store in the 2300 block of McCallum Road that an intoxicated man was causing a disturbance.
Police then found Casgrain, the alleged suspect, in the 33000 block of Mayfair Avenue. Casgrain allegedly tried to punch the officer who arrived on scene and placed him in handcuffs, MacDonald said.
One of the conditions of his bail is that he not consume alcohol. Casgrain was taken into custody and was released on $500 bail. He is next due to appear on the charges May 5 in Abbotsford provincial court.
He is also slated to be sentenced Sept. 6 in Chilliwack Supreme Court after pleading guilty to the aggravated assault of Hendrikje (Ricky) Priester.
Priester, 52, was found dead by police in the couple's Mayfair Avenue apartment approximately 12 hours after a 911 call was made from the home on March 25, 2008. An operator who answered the call did not believe it was an emergency and thought it was related to a theft that might have occurred.
Abbotsford Police formally apologized to the Priester family for not dispatching officers to the home when the call was placed.
Casgrain was initially charged with second-degree murder. Those charges were stayed in May 2008, and Casgrain faced the lesser charge of manslaughter a few months later.
That charge was dismissed last year, due to lack of evidence for a conviction, and he pleaded guilty to aggravated assault. Sentencing was originally scheduled for September 2010, but has been delayed numerous times because Casgrain was recovering from being struck by a car while crossing the road in his mobility scooter.
