The murder trial for Jamie Bacon has been postponed until March, 2018, making it nine years he will have been waiting for due process.
CBC is reporting that Justice Kathleen Ker said from the bench on Thursday from Vancouver Supreme Court that the defense is crafting an application for a stay of proceedings.
If successful, Bacon would be set free.
The so-called Surrey Six slaying left six dead, including two innocent bystanders.
The trial itself is expected to last for six to nine months.
To this point, four people have been convicted, or have pleaded guilty, to a told in the murders of Corey Lal, his brother Michael, associates Ryan Bartolomeo and Eddie Narong, and bystanders Ed Schellenberg and Christopher Mohan.
In December 2014, Cody Haevischer and Matthew Johnston were sentenced to life in prison after being found guilty of six counts of first degree murder and one count of conspiracy.
They are appealing that conviction.
Michael Le pleaded guilty to conspiracy to commit murder and was sentenced to 12 years.
One person, who can only be identified as Person X by court order, pleaded guilty to second-degree murder for three of the murders and was sentenced to life with no parole for 15 years.
In non-murder trials, time in custody prior to trial often counts as double time when sentencing is given.
That's not the case in murder trials. Typically, time served will come off the time required for parole eligibility.
But in murder, that's counted as straight time.
